General Terms of Use

1Article 1 — Object
These General Terms of Use govern access to the www.dp-manager.com website and the use of the DP-Manager software platform, published by SARL LEADERSOFT ALGÉRIE. They apply to professional clients as well as users authorized by these clients. Accessing or using DP-Manager implies compliance with these terms, without prejudice to provisions set forth in the commercial or subscription contract concluded with the client.
2Article 2 — Role of DP-Manager
DP-Manager is a software platform intended to support organizations in organizing, documenting, and tracking their compliance process with Law No. 18-07 on personal data protection.
DP-Manager constitutes a management and documentation assistance tool. The platform alone does not guarantee legal compliance for the organization using it.
Using DP-Manager does not exempt the client from:
- analyzing their own processing activities;
- determining applicable purposes and legal bases;
- defining categories of data and data subjects;
- informing data subjects;
- defining recipients and retention periods;
- implementing appropriate technical and organizational measures;
- completing required formalities with the ANPDP;
- seeking legal or specialized advice when necessary.
Templates, notices, documents, and features proposed in DP-Manager must be verified and adapted by the client before use or dissemination.
Article 3 — Service Access
Access to the DP-Manager platform is reserved for professional clients with a valid contract or access right.
Upon activation of the client space, LEADERSOFT ALGÉRIE creates a main administrator account for the client. An activation email is automatically sent to the designated administrator.
The client administrator is then responsible for creating, managing, modifying, and deactivating user accounts linked to their organization, as well as assigning roles and authorizations in DP-Manager.
Article 4 — Accounts and Credentials
Each user account is personal.
Each user is responsible for the confidentiality of their credentials and operations performed from their account.
Credentials must not be shared with unauthorized persons.
In case of loss, compromise, or unauthorized use of an account, the user must immediately notify their organization administrator and, when necessary, DP-Manager support.
Article 5 — Client Responsibilities
The client remains responsible for:
- processing activities created, entered, and administered in DP-Manager;
- lawfulness, accuracy, relevance, and updates of entered data;
- selection of purposes and legal bases;
- informing data subjects;
- definition of recipients and retention periods;
- handling data subject rights requests;
- formalities required by ANPDP;
- creation and management of user accounts;
- assignment of roles and authorizations;
- verifying and adapting templates and documents before use;
- compliance with legal and regulatory obligations applicable to their activity.
6Article 6 — Role of LEADERSOFT ALGÉRIE
LEADERSOFT ALGÉRIE acts as data controller for data it collects and uses for its own needs related to the website, commercial management, clients, user accounts, support, billing, security, and platform operation.
For data entered, imported, or administered by clients in their DP-Manager spaces, the client remains data controller.
In this framework, LEADERSOFT ALGÉRIE acts as technical data processor, in accordance with client instructions and applicable contractual provisions.
Article 7 — Prohibited Uses
It is specifically prohibited to:
- use DP-Manager for illegal or fraudulent purposes;
- enter or process data without an appropriate legal basis;
- attempt to access another client's space, accounts, or data;
- bypass or neutralize security mechanisms;
- disrupt platform operation;
- introduce malicious code;
- copy, modify, disassemble, or extract software without authorization;
- communicate credentials to unauthorized persons;
- use the platform in a manner violating third-party rights.
©Article 8 — Intellectual Property
The site, DP-Manager trademark, software, source code, interfaces, texts, visuals, templates, documents, and associated content are protected by applicable intellectual property legislation.
The right of use granted to the client is limited, personal, non-exclusive, and non-transferable for the duration of their contract.
Any unauthorized reproduction, adaptation, extraction, redistribution, or exploitation is prohibited.
9Article 9 — Personal Data
The conditions under which LEADERSOFT ALGÉRIE collects and processes personal data are described in the Privacy Policy accessible on the site.
For data entered and administered by a client in their DP-Manager space, the client remains data controller and LEADERSOFT ALGÉRIE acts as technical data processor.

The site may use cookies or similar technologies necessary for operation, security, audience measurement, or integration of third-party services.
The site may specifically integrate content hosted on YouTube.
Consulting this content may result in cookie placement or technical data transmission to the relevant provider.
Users may manage their preferences in browser settings and, when available, through the cookie management tool provided on the site.
Article 12 — Availability, Maintenance, and Security
LEADERSOFT ALGÉRIE implements reasonable technical and organizational measures to ensure availability, security, and smooth operation of DP-Manager.
The platform may however be temporarily interrupted for maintenance, update, security operations, or events beyond LEADERSOFT ALGÉRIE's control.
Permanent, continuous, and uninterrupted availability cannot be guaranteed.
Article 13 — Liability
LEADERSOFT ALGÉRIE is responsible for technical provision of the service within limits set by regulations and applicable contractual provisions.
LEADERSOFT ALGÉRIE cannot be held responsible for consequences resulting notably from:
- inaccurate, incomplete, or unlawful data entered by the client;
- incorrect configuration by the client;
- inappropriate assignment of authorizations;
- documents or templates used without verification or adaptation;
- failure to fulfill an obligation or formality incumbent on the client;
- use contrary to these conditions;
- sharing, loss, or compromise of credentials attributable to the user;
- interruption due to maintenance operations, force majeure, or events beyond control.
No provision of these terms may exclude liability that cannot legally be excluded.
14Article 14 — Platform Evolution
LEADERSOFT ALGÉRIE may evolve features, interface, and documentation of DP-Manager to improve service or reflect legal, regulatory, technical, or security developments.
Substantial changes likely to affect service use will be brought to clients' attention by appropriate means.
15Article 15 — Suspension and Termination of Access
Access to DP-Manager may be suspended or interrupted notably:
- upon expiration or termination of contract;
- in case of non-payment, according to contractual provisions;
- in case of security risk for the platform;
- in case of unlawful use or violation of these terms;
- upon request from a competent authority.
Modality for restitution, export, retention, or deletion of data upon contract end are defined by contract or subcontracting provisions.
Article 16 — Applicable Law
These General Terms of Use are governed by Algerian law.
Any dispute will be brought before courts of competent territorial jurisdiction, subject to mandatory rules and contractual agreements.
